How will my Human Rights case be assessed?
This will depend on the facts of your case. Your case is likely to fall either within or outside the Immigration Rules. If your case does not satisfy the requirements of the Immigration Rules, an assessment outside the Immigration Rules will be made. An assessment outside the Immigration Rules will consider whether other relevant legislation can be applied to and enforced on your case (Domestic, European and/or International law).
Yes, you may qualify for an exception to the rules if you have:
· A Child or Children in the UK
· A Partner in the UK
To establish a private life under the immigration rules, you need to satisfy requirements relating to:
· Suitability
· Length of Time in the UK
If my case does not satisfy the requirements of the immigration rules, or is outside of the immigration rules, are there any other grounds on which I can apply to stay in the UK?
This depends on the circumstances of your case. We will assess whether you may still qualify for permission to stay in the UK on the following grounds:
· Exceptional or Compellingly Compassionate Grounds
· International Protection (See Asylum)
· Child Responsibility
