Indefinite leave to remain (‘ILR’), otherwise known as settlement in the UK, is the status given to someone who has been granted permission to live in the UK permanently without the need to make any further applications to remain. Whether you are eligible for ILR depends on factors which include the immigration category for which you have currently been given permission to remain and your length of residence in the UK.

If you genuinely fear going back to your country for one of the reasons mentioned above, then you must make your claim for asylum as soon as possible. Any delay in making your claim for asylum could prejudice your claim and result in it being rejected. If there has been a delay, UK Visas and Immigration (UKVI) are likely to question and investigate your reasons for not making a claim for asylum earlier. If your reasons are not considered to be plausible in the circumstances of your case, this could severely compromise your prospects of making a successful claim.
There are different methods through which to apply for a spouse visa depending on whether you are applying from within or outside of the UK.
If you are applying from outside of the UK, the method is:
· Entry Clearance
If you are applying from inside the UK, you can apply to:
· Extend Your Current Spouse Visa
· Switch Your Current Visa to a Spouse Visa
